Tampa Bay Buccaneers linebacker Shaquil Barrett lost his 2-year-old daughter in a drowning accident at their home swimming pool Sunday, according to investigators.

Officers arrived at the family’s swimming pool in the Beach Park district of south Tampa shortly before 9:30 a.m. after receiving a call about a toddler who had fallen into a pool.

Barrett’s youngest child was rushed to the hospital, but ultimately died.

According to the police report, the inquiry is still ongoing. It is believed that this was an accidental, tragic incident.

Barrett, 30, and his wife also have three more kids.

Barrett, who missed the second half of last season due to a damaged Achilles tendon, is entering his fifth year with Tampa Bay after completing his first four seasons with the Denver Broncos.

Untitled-design-27-200x300The most frequent type of injury that results from swimming pool mishaps is drowning. According to the Centers for Disease Control and Prevention, drowning is the second most common cause of unintentional injury death in children between the ages of one and fourteen. Most of these drownings take place in family swimming pools.

Florida had the highest rate of unintentional drowning deaths among children aged 1 to 4 in the United States from 2018 to 2020, according to the Florida Department of Public Health. Here is the breakdown of the number of children under the age of 5 in Florida who drowned in the past few years:

  • 2019 – 50 children
  • 2020 – 60 children
  • 2021 – 75 children

Premises liability is a subset of personal injury law that covers accidents that happen on either public or private property and includes swimming pool mishaps. In circumstances involving premises liability, you may bring a lawsuit against the property owner if their carelessness contributed to or caused your damage.

Who Is Responsible for a Drowning Disaster in a Swimming Pool?

Whether the pool is public or private, the property owner is typically responsible. A municipality may be held responsible in the case of a public pool.

The owner of a private swimming pool is liable when a drowning accident occurs on their property. Typically, an insurance claim would be made against the homeowner’s insurance policy.

Depending on the accident’s cause, other responsible parties may also include a pool maintenance firm or a manufacturer, distributor, or retailer of a defective product.

Our Florida Swimming Pool Accident Attorneys Whittel & Melton assist victims and their families in holding negligent pool owners responsible. You may be entitled to financial compensation for your suffering, including:

Florida is consistently ranked in the top 5 states in the U.S. with the most fatalities from car accidents. Initial figures from the Florida Department of Highway Safety and Motor Vehicles (FLHSMV) shows that the Sunshine State has already seen 115,093 traffic crashes in 2023 resulting in 982 deaths and 74,021 injuries. In 2022, Florida saw 3,245 fatal traffic crashes. In 2021, Florida saw 3,454 car accident deaths. In 2020, Florida saw 3,332 car accident deaths.

Untitled-design-26-200x300Tampa Bay and Southwest Florida have several dangerous roads that contribute to the high number of fatalities from car crashes.

  • S. Route 19 Embassy Blvd – Marine Parkway: This is a 4.4-mile stretch of highway that runs through New Port Richey in Pasco County that saw 19 fatalities in 2022 alone.
  • S. Route 19 Denton Ave – San Marco Dr: Also located in Pasco County, this 4.9-mile stretch of roadway saw 25 traffic deaths in 2022.
  • S. Route 19 54th Ave N. – Queensboro Ave S: This 4.7-mile stretch of highway in St. Petersburg saw 20 traffic deaths in 2022.
  • S. Route 19 Lake Tarpon Dr – Royal Blvd: This 4.4-mile stretch of roadway in Pinellas County saw 17 car crash deaths in 2022.
  • S. Route 41 23rd Ave – Pearl Ave: This deadly stretch of roadway located in West Bradenton saw 22 traffic fatalities in 2022.
  • Florida State Road 580 Webb Rd – W. Waters Ave: This 4.8-mile stretch of roadway in Tampa saw 18 car accident deaths in 2022.

The geography of these roads may contribute to the high number of traffic deaths, but drunk driving and distracted driving also play a large role in the startling number of fatalities. There were 268 alcohol and drug-impaired fatalities in Florida in 2022, according to data from the FLHSMV. In that same year, Florida also saw 268 distracted driving fatalities. Continue reading

With the month of April wrapping up, our Florida Auto Accident Attorneys at Whittel & Melton wanted to remind everyone about a few distracted driving tips that can help you stay safe on the roads.

April is Distracted Driving Awareness Month, and the National Highway Traffic Safety Administration released its 2021 report on fatal crashes this month showing some startling statistics. In 2021, 3,522 people died in distracted driving crashes throughout the United States. In this same year, a total of 43,000 lives were taken in car crashes, a 10.5% increase from 2020. This is the largest percentage increase in car crash fatalities since 1975.

Distracted driving easily happens and can involve anything that causes drivers to avert their eyes from the road onto something else. The most common distracted driving behaviors we hear about involve cell phones or other electronic devices – making phone calls, sending/reading text messages, checking emails, scrolling through social media, playing games, watching videos, etc. These are all dangerous activities to do while driving as this increases your odds of becoming involved in a car crash.

Untitled-design-25-200x300There are also other distractions that can affect motorists while driving, including:

  • Eating or drinking
  • Applying makeup or engaging in other personal grooming
  • Adjusting a car’s radio dials or fiddling with AC/Heat controls
  • Typing in GPS navigation directions
  • Reaching for objects on other seats or on floorboards
  • Daydreaming
  • Checking out billboards, buildings, other cars, pedestrians, bikers, etc.
  • Engaging in conversations with passengers in the vehicle
  • Trying to help children in the back seat with something
  • Jotting down a quick note
  • Reading a newspaper/magazine/book

The thing about driving is that motorists behind the wheel must be able to react quickly to what is happening around them. When drivers are distracted, they simply cannot do this. Any distracted driving behavior that takes your eyes off the road for a mere 5 seconds when traveling at 55 mph is the equivalent of driving the entire length of a football field with your eyes closed. If you are reading a text message and fail to see the driver in front of you has slowed down or stopped, then you could cause a rear-end crash.

The dangers of distracted driving only increase the faster the speed you are travelling. If you are on an interstate or highway and fail to notice an obstacle in your path, then you could wind up causing a dangerous pileup crash or even a rollover accident.
